The short answer
Yes, it's often possible. California has no blanket ban on alcohol licenses near schools or churches. Instead, the application asks you to list nearby “consideration points” (ABC-251), and ABC weighs the impact.
What the law actually says
- Business & Professions Code §23789 lets ABC refuse a retail license for premises within the immediate vicinity of schools, public playgrounds and nonprofit youth facilities — in practice, within 600 feet. It's discretionary: “may refuse”, not “must”.
- ABC-251 also asks about churches and hospitals within 600 feet, so investigators can consider them.
- Rule 61.4 separately covers residences within 100 feet of the premises or parking lot (see ABC-247).
- Local zoning may add its own distance rules for bars, liquor stores or cannabis — check with your city planning department too.
What usually happens
For a restaurant serving beer and wine (Type 41), a nearby school or church rarely blocks the license on its own. For bars and liquor stores, ABC looks harder, and conditions are common: limited hours, no single-serve sales, no signs facing the school, or security requirements. Protests from the school or neighbours carry weight.
